His nine appendixes present a "Motion Picture Industry Overview," "Profit Participation Audit Firms," "ADI (Top 50) Market Rankings," an "AFMA Member List, 1992–1993," a "Production-Financing/Distribution Agreement," a "Negative Pickup Distribution Agreement," a "Distribution Rights Acquisition Agreement," a "Distribution Agreement (Rent-a-Distributor Deal)," and a "Foreign Distribution Agreement."

Cones wrote this book for independent producers, executive and associate producers and their representatives, directors, actors, screenwriters, members of talent guilds, distributors, and entertainment, antitrust, and securities attorneys. Securities issuers and dealers, investment bankers, and money finders, investors, and financiers of every sort also will be interested. In addition, Cones suggests and hopes that the book will interest "Congress, their research staff, government regulators at the Internal Revenue Service, the Securities and Exchange Commission, the Federal Trade Commission, and law enforcement officials such as the Los Angeles District Attorney and the U.S. Justice Department."

About the Author

John W. Cones was a practicing securities/entertainment attorney based in Los Angeles during the time he researched and wrote this book. He is a prolific writer and lecturer on film finance. His books include Film Finance and Distribution—A Dictionary of Terms, Film Industry Contracts, and 43 Ways to Finance Your Feature Film, also available from Southern Illinois University Press. Currently seeking to encourage interest in the reform of the U.S. film industry, he is working as a staff attorney in the U.S. Congress.

Encyclopedia of Bad Film Studio Business Practices

If you are mystified by "Hollywood accounting," this legal expose outlines over 80 clauses commonly found in feature film distribution contracts that might be considered unconscionable or immoral, revealing the formidible odds facing the "talent" side of the industry. A thorough explanation of why there's no "net" profit, and a sobering dose of reality for any creative person who believes they should be paid for making a good product. The introduction lists the LA DA's Office among those who should read it.

Though a little dated (not much has changed in the film industry), The Feature Film Distribution Deal is a must-read for every producer and every newly minted entertainment lawyer.

The author, a practising entertainment lawyer) covers typical/standard/boilerplate film industry deal contracts as issued by the big studios/distributors, and explains practically every line/item in them, and the definitions of the many contract terms.

BTW, ALL the terms of these contracts are rigged to screw independent producers out of net profit participaiton profits.

Then the author offers 'counter' negotiating points and the reasoning/arguments behind them.

He does state that success in using these counterproposals/arguments is limited due to the 'balance of power' between big studios and independent producers is tilted heavily in favour of the big studios.

The appendices are four distribution deal contracts. They're well worth the read, too, if only to familiarise oneself with them.

It is NOT a book to read quickly, but one to be read thoughtfully, to absorb and to learn the legal and business concepts in the contracts. The structure of each chapter makes this easy to do.

Good stories, but...

Wilby tells exciting stories, and I admit that her love of adventure is infectuous, even though her writing style isn't my favorite. However, I lose patience with her almost automatic reverence for Tibetans as it contrasts against her utter disgust for the Chinese, whose culture she repeatedly labels "ugly." At one point she writes that out of two billion Chinese in the world there are only two decent people -- a helpful duo she meets on her journey. This uncontrolled prejudice is contrary to the tolerant spirit most "world travelers" would hope to embody, and I am astonished that such thoughtless sentiments were included in the final, published draft. Yes, it is tempting to rally behind the underdogs in a situation such as Tibet's, but that does not require a sympathizer to heap disdain upon the entire nation of China. Turn the lense -- if compassion were indeed "earned" by membership in some flawless political or cultural entity, westerners abroad certainly have no business relying on others' goodwill to the extent that Wilby relied on that of her Tibetan hosts.

Journey Across Tibet

I found Ms. Wilby's story exciting, so much so that I kept the book and for years I dreamed of making a similar trek. Now, with my adventurous daughter planning to travel, I decided to give her the book. However, as I read some of her negative passages about China it brought back memories of signs throughout China that read "No Dogs or Chinese in the Park." I fail to see how she could be so blind as to the role of Western powers in Chinese history as to call them uncultured. That bias puts an asterisk on an otherwise wonderful book.

About the Author
Wiktoria Sliwowska is a historian and professor at the Institute of Polish History at the Polish Academy of Science in Warsaw. A member of the Association of the Children of the Holocaust in Poland, her account is included in this volume.

Julian Bussgang, an engineer and entrepreneur, was born in Lwów, Poland, and served during the war in the Free Polish Army. He has lived in the United States since 1949. In the last few years, he and his wife, Fay, have spent a great deal of time in Poland and have become very interested in the small Jewish community that remains there.

Memories of Lost Childhood

In The Last Eyewitnesses, the editor, Wiktoria Sliwowska, has presented her own testimony of the destruction of Polish Jewry as well as those of her contemporaries. These have been assembled by the Association of the Children of the Holocaust in Poland. The special character of this anthology lies in the fact that these Jews, mostly in their sixties and seventies now, have come together to relate their childhood memories of the Holocaust, when childhood was denied to them. The reader becomes a witness to a unique cathartic experience. The translation of Julian and Fay Bussgang has given the English reader the opportunity to encounter these testimonies, full of the stark details which contradict everything expected from childhood. Primarily, these survivors learned that in their circumstances, it was dangerous to be a Jew. These children spent at least six years of their lives trying to divest themselves of their Jewish identity. They had to change their names, sometimes several times, change their language, in many cases, and learn Catholic prayers and rituals. As one sees by the names listed in the table of contents, many have never really recovered their identities as Jews. The histories provided demonstrate that there can be life after the Holocaust, but there can never be an elimination of its legacy. And this legacy will extend beyond the lives of even these and other last witnesses.

It is chilling to hear of the young who, besides being faced with constant want and privation and witness to violence and brutalization, also have to deal with an immediate and mature realization that their own lives are tenuous and threatened day by day. One individual describes his fear and panic, as he and his sister fled from their pursuers into the woods, as well as the subsequent pain and guilt for having separated from her during their attempted escape. His path led to life, while hers led to death. It is painful to read of children who are clearly aware that in their circumstances, it is dangerous to be a Jew. A new word has entered their Jewish vocabulary, "Action", a raid by Germans and their cohorts to seize Jews for death, either to be killed on the spot or taken to the death camps. One can scarcely imagine living with the ever-present fear of being discovered - afraid of one's dark Jewish appearance, living in cellars or closets, forbidden to approach a window, hiding in the woods. The sad fate of Polish Jewry is revealed in the statement of one teenage girl upon returning home after liberation: "...In my one and only little dress, without a cent to my name, I traveled to where Mama, Dorota, and the rest of the family were sent to the ghetto. Here, after arriving at my destination, I lived through the worst moment of my life. I did not anybody, not a single blessed soul." Not only did they not find many of their loved-ones or any vibrant Jewish community after the War, but they found anti-Semitism still alive, though their families were dead. These children spent at least six years trying to divest themselves of their Jewish identity. They had to change their names, sometimes several times, change their language, in many cases, and learn Catholic prayers and rituals. Many survivors have never returned to their original, Jewish names. As one sees by the names listed in the table of contents, many have never really recovered their identities as Jews. One individual expresses his confusion about whether he is a Jewish-Pole or a Polish-Jew. The histories presented here cover the entire gamut from total alienation from Jewish contacts to strenuous effort to learn about their background and Israel. As one reads the various depositions, one is amazed that any children could have lived through such inimical circumstances. One is amazed at the efforts of courage and sacrifice, love and desperation on the part of these parents to give up their children to strangers in the hope that they might live through the horrible German regime. One is also amazed at the stories of great courage on the part of many Poles in the rescue efforts described. "Antek" Cukierman, hero of the Warsaw Ghetto, has commented that one Pole could betray a hundred hiding Jews, but it took a hundred Poles to save a single Jew. These accounts verify that reality, as does Yad Vashem's recognition of many of them to be included in the ranks of the Righteous Among the Nations. The people who have come forth in the aftermath of the Holocaust to give these accounts of their personal lives and tragedies, as they struggle to define their identities, have gone on to demonstrate that there can be life after the Holocaust, but there can never be an elimination of its legacy.And this legacy will extend beyond the lives of even these and other last witnesses. Polish child survivors speak of their Holocaust experiences.

The 65 personal histories chronicled here represent the scope and variety of experiences Polish child survivors of the Holocaust underwent. They tell of kindness and cruelty, of good luck and bad, of the survival of a complete nuclear family and the survival of one who knows only that he is, by origin, a Jew. Because this these people originally came from all over Poland, they faced persecution by not only the Nazis and their Belarussian, Lithuanian, Polish, and Ukrainian collaborators, but also from the Ukrainian Insurgent Army and various other anti-Semitic, anti-Polish groups.
Most of these chronicles convey the sense of absolute aloneness and isolation their tellers must have felt. However, a number reveal connections among the group of contributors, connections that hint at the scope of the Jewish community that existed in Poland before the Nazis invaded.
The individual stories are compelling. Their cumulative effect is powerful. They bear witness to the spectrum of human capacity for good and for evil, and, above all, to the twists of fate that meant the difference between death and survival. Accounts of the lingering, ever-present effects of suffering resulting from the events of over 50 years ago serve as reminders that the past is, indeed, never really over.

A classic account of a trip through China during the golden age of travel

In 1935 Ella Maillart contemplated one of the most arduous journeys in the world: the "impossible journey" from Peking, then a part of Japanese-occupied China, through the distant province of Sinkiang (present day Tukestan), to Kashmir. Enlisting with newswriter Peter Fleming (with the caveat that his company remain tolerable), Maillart undertook a journey considered almost beyond imagination for any European and doubly so for a woman.
The trip promised hardships such as typhus and bandits, as well as the countless hazards surrounding the civil war between Chinese communists and Chiang Kai-shek's nationalists. Setting out with pockets full of Mexican money (the currency used in China at the time), Maillart encountered a way of life now lost, but one that then had gone unchanged for centuries.

Maillart describes it all with the sharp eye and unvarnished prose of a veteran reporter-the missionaries and rogues, parents binding daughters' feet with rags, the impatient Fleming lighting fires under stubborn camels. It's a hard road, not that Maillart cares. At all times she is a witty, always-enchanted guide-except when it comes to bureaucrats.

Forbidden Journey ranks among other travel narratives like Fleming's News from Tartary, (based on the same journey) and Robert Byron's The Road to Oxiana. But it is also a portrait of a fascinating woman, one of many women from the pre-WWII era who ignored convention and traveled in hidden lands. It remains a vivid account of its time and a classic of travel literature.

About the Author
Ella Maillart was born in Switzerland in 1904. An Olympic athlete, actress, movie stuntwoman, and captain of the Swiss Ladies Hockey Team, Maillart also found time to travel widely in Asia. In 1939 she and her companion Annemarie Schwarzenbach drove from Switzerland to Afghanistan, a trip described in Maillart's book The Cruel Way (Beacon, 1987). Her other books include Turkestan Solo (Long Riders Guild, 2001). She died in 1997.

Not worth the money

This is a barebones edition that never should have been published. The original contains some 67 photographs, including a few very useful maps. They add immensely to the pleasure of reading Maillart's narrative. Aside from the cover, this edition contains none.

Much better to search out an independent bookseller through [...] and buy an earlier edition with the photographs in parallel with buying an earlier edition of Peter Fleming's travelogue for the same trip. Though both authors describe the facts of the travel from Beijing to India along the southern Silk Road route, their descriptions of their inter-personal interactions and among the people they encounter along the journey are very different and complementary.

I read this book years ago while I was living in France and I left my copy there. I have often wished I still had it. It's doubly entertaining and informative to read with the Peter Fleming book.

I'd like to give you more details, but it's been so long, only the pleasure of the tale lingers.

A great classic of travel writing

I knew about this book from reading Peter Fleming's account of the same journey (News from Tartary: An Epic Journey Across Central Asia), but it was much more recently that I was able to find a copy (in French: so although I hope I can give an accurate assessment of Ella Maillart's qualities as a writer, I can say nothing about the accuracy and readability of the translation into English). Anyway, if you've read Fleming's book read this as well, because it's very different, though based on the same facts; if not, then read both, for the same reason. If the version available lacks pictures and maps then that's a pity, but it's not a disaster (I don't agree with another reviewer who thought that the lack of these justified a one-star review), because the main reason for reading either book is the fascinating picture of China in the 1930s -- the period of very weak government from Nanking with large parts of the country virtually out of even weak government control, including most of the way from Pekin to India that Maillart and Fleming took. There was a very strong degree of Russian (Soviet) infiltration in western China, and the Chinese tended to think all western foreigners were Russian spies -- especially ones like Maillart who sometimes needed to hide the fact that she could speak Russian fluently.

Perhaps the most amazing aspect is that the expedition of seven months from Peking to Srinagar was successful, with so many things that could have gone wrong -- Maillart or her companion could have drowned while crossing a river; they could have fallen over a precipice; they could have died of starvation, thirst or disease; they could have been shot by rebels. Not only did none of these things happen, but the most likely disaster of all didn't happen either: they could have been turned around and forced to go back to Peking, possibly under arrest. They had to pass endless passport inspections and other controls, but although these caused many delays, they always managed to continue (though their Russian companions on the early part of the journey, whose presence had seemed almost essential for success, were less fortunate). Right up until the last control before reaching India they could have been stopped, and as they had no legal right to be where they were they needed to expect the worst. Their documents were in Chinese, but as many of the officials who stopped them didn't recognize the weak government in Nanking and many of them could not read Chinese that was no guarantee.

Maillart was fluent in Russian (very useful in western China), and Fleming could speak some Chinese, but they had little knowledge of the various other languages they needed, but somehow they managed. Maillart was also an expert sportswoman -- sailing, hockey and skiiing, none of which were useful accomplishments for travelling through China -- and although the whole story of her life suggests otherwise the impression one gets from reading her book, and Fleming's, is of someone of great competence and stability. They shared out the work in a way that is probably typical of man-woman teams: he did all the shooting and negotiating with the Chinese; she did the less exciting things like cooking, and repairing and washing clothes. Nonetheless, they managed to maintain a cordial relationship for seven months. As Fleming remarks (but she does not: he says much more about her, entirely complimentary, than she does about him), by all the standards of literature of the time (no less than today) during that time they should have ended up madly in love or hating one another, but apparently neither of those things happened.

Great stories through poems

You will have a hard time finding Rice in a bookstore. I know --I've looked and looked.

When you first see the book, you'll notice the cover art. (Too bad there is no image available on amazon.com.) Besides being so strong visually, the cover is exceptionally beautiful. But wait ... you haven't even made it to the inside yet. Nikky Finney is such a good writer. And you don't have to be a student of poetry or a poet to appreciate her writing. She is a great story teller and it just so happens that she has picked the art of poetry as the structure for her stories.

Start reading ... "The Blackened Alphabet" ... "Irons At Her Feet" ... "Yellow Jaundice" ... and you enter her family's South Carolina home. There's some deep stuff here. It's a journey you take with your whole self. Finney gives the best part of herself and makes you feel like you are on the journey too with the best part of yourself. These stories will stay with you.

And one more thing: I think "The Turtle Ball" is one of the sexiest poems I've ever read.

One of the most outstanding African-American poets of the turn-of-the-century, Nikky Finney presents her second collection of poetry in *Rice*. Some of my favorite poems in the book are "Black Orion," "Burning Hair" and "The Goodfellows Club." A truly must-read collection from one of America's greatest rising poets.

A very good collection of poems.

I had the great opportuity to meet this brillant poet, and have had the chance to hear her read some of the works from Rice. This book is wonderfully composed of poems that tug at your inner emotions and of those that are quite thought-provoking. It's a nice change to to experience the raw words that make up Rice, rather than something that seems scripted and practiced. I wouldn't expect anything but the like from Ms. Finney.

Wagenknecht is the best

Edward Wagenknecht is, to my mind, the preeminent critic of silent film; his "Movies in the Age of Innocence" is my all-time favorite book on the silent era. This book is a collection of some chapters from "Movies in the Age of Innocence," published when that book was out of print, as well as a new (I believe) essay on Clarine Seymour. I'd strongly recommend "Movies in the Age of Innocence" if you have the opportunity to read it; if not, this book is a fine stopgap measure.
